Please read these Terms & Conditions carefully before using mozgallery. By accessing or purchasing from our website, you agree to be bound by these terms.
1. About us
mozgallery is an online art gallery selling original paintings and offering custom commission services. All artworks sold on this website are original, hand-painted pieces.
Contact: [email protected]
2. Products
All artworks listed on this website are original, one-of-a-kind paintings. Each item is described as accurately as possible, including dimensions, medium, and technique. Colours may vary slightly due to monitor calibration differences.
Once an artwork is sold, it is no longer available. Sold-out paintings may be available for commission — see Section 6.
3. Prices and payments
All prices are displayed in EUR and include VAT where applicable. We reserve the right to change prices at any time without prior notice; changes will not affect orders already confirmed.
Payments are processed securely through third-party providers (e.g. Stripe, PayPal). We do not store your payment details. By completing a purchase you confirm that you are authorised to use the payment method provided.
4. Offers
Registered customers may submit a private offer on selected artworks through the “Make an Offer” feature. An offer is not binding and does not constitute a purchase. We reserve the right to accept, counter, or decline any offer at our sole discretion.
Once an offer is accepted and payment is completed, the standard order and shipping terms (Sections 5 and 6) apply.
5. Shipping and delivery
Original artworks are carefully packaged and shipped worldwide. Delivery times and costs depend on the destination and are displayed at checkout.
- Artworks are shipped within 5–10 business days after payment confirmation
- Larger or commissioned paintings may require additional preparation time — you will be notified
- We are not responsible for delays caused by customs or third-party carriers
- Risk of loss or damage passes to the customer once the artwork is handed to the carrier
For full details see our Shipping & Delivery page.
6. Returns, refunds and right of withdrawal
6.1 Right of withdrawal — standard artworks
In accordance with EU Directive 2011/83/EU and Italian Legislative Decree 21/2014, consumers have the right to withdraw from the purchase of a standard (non-commissioned) artwork within 14 days from the date of delivery, without providing any reason.
To exercise this right:
- Notify us of your decision to withdraw before the 14-day period expires, by email at [email protected]
- Return the artwork within 14 days of notifying us, at your own expense
- The artwork must be returned in its original condition and packaging — any diminution in value due to handling beyond what is necessary to establish its nature will be deducted from the refund
- We will issue a full refund of the purchase price within 14 days of receiving the returned artwork
6.2 Commissioned paintings — no right of withdrawal
Pursuant to Art. 59(1)(c) of EU Directive 2011/83/EU, the right of withdrawal does not apply to commissioned paintings, as these are goods made to the customer’s specifications or clearly personalised. Deposits paid are non-refundable once work has commenced.
6.3 Damaged or incorrect items
If the artwork arrives damaged or differs materially from its description:
- Notify us within 48 hours of delivery by email with photos of the damage
- We will arrange collection at our expense
- A full refund will be issued once the artwork is received and inspected
7. Commission a painting
We offer custom painting commissions. To request a commission, complete the form on the Commission a Painting page. Submitting a request does not constitute a binding order.
After reviewing your request, we will provide a personalised quote and timeline. The commission begins only after written agreement and payment of a deposit (typically 50%). The balance is due before shipping.
- Deposits are non-refundable once work has commenced
- You will receive progress photos for approval at key stages
- Final delivery time will be agreed individually
8. Intellectual property
The purchase of an artwork transfers ownership of the physical painting only. All intellectual property rights — including copyright and reproduction rights — remain exclusively with mozgallery, unless otherwise agreed in writing.
You may not reproduce, distribute, or commercially exploit any artwork or image from this website without prior written permission.
9. User accounts
To access features such as “Make an Offer” or track your orders, you may create an account. You are responsible for maintaining the confidentiality of your account credentials. Please notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
10. Limitation of liability
To the fullest extent permitted by law, mozgallery shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or the purchase of artworks. Our total liability shall not exceed the amount paid for the artwork in question.
11. Privacy
Your personal data is processed in accordance with our Privacy Policy and Cookie Policy.
12. Governing law
These Terms are governed by Italian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of the data controller’s place of business, unless otherwise required by applicable consumer protection law.
13. Changes to these terms
We may update these Terms & Conditions from time to time. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
